Terms of Sale

The terms for buying premium items, extra tables and wall posters in Traluno, sold by Timesheet - Mobile Time Tracking OG, Vienna.

These terms apply when you buy something in Traluno. Playing is free and needs none of this; everything below is about the things that cost money.

1. Who you are buying from

The seller is Timesheet - Mobile Time Tracking OG, Untere Weißgerberstrasse 43 1/2, 1030 Vienna, Austria, registered at the Commercial Court Vienna under FN535499z, VAT ID ATU75714737. The full company details are in the Legal Notice. You can reach us at hello@traluno.com.

In these terms, "we" and "us" means that company, and "you" means the person buying.

2. What these terms cover

They apply to every purchase in Traluno:

  • premium items from the catalog: buildings, trains, vehicles and scenery,
  • extra tables, which make room for a bigger layout, and
  • wall posters, pictures that hang on the walls of the game for everyone who plays.

They apply whether you buy as a consumer or for a business. Where a rule applies only to consumers, it says so. A consumer is someone buying mainly for purposes outside their trade, business or profession. Terms of your own do not apply unless we agree to them in writing.

The contract is made in English.

3. Your account

You need a Traluno account to buy anything. You sign in with a one-time code sent to your email address; there is no password. Everything you buy is recorded on that account, so keep the mailbox to yourself: anyone who can read it can sign in as you.

You need to be old enough to enter into a contract where you live, or have the consent of a parent or guardian.

Your purchases stay with the account. If you ask us to delete it, they go with it, because there is nowhere else for them to live. We do not close an account that has bought something without good reason, such as a serious breach of these terms, and we tell you before we do.

4. What a purchase gives you

Buying a premium item or an extra table gives you a licence: the right to use that item inside Traluno, on any device you sign in on, for as long as your account and the game exist (see section 12).

The licence is bound to the account it was bought on. You cannot transfer it, sell it or give it to another account, and it has no cash value: it cannot be exchanged for money, credit or another item. The model, its design and the code behind it stay ours.

Each extra table adds one table to your layouts, up to four tables in all.

A wall poster buys display time rather than a licence; see section 8.

5. Prices and payment

Prices are shown in US dollars and include VAT where it applies. The price that counts is the one shown on the payment page when you pay.

Payments are processed by Stripe Payments Europe, Ltd. on Stripe's own payment page, and we never see your card details. You can pay with any of the methods that page offers. If your card is in another currency, your bank may charge for the conversion; that is between you and your bank.

Premium items and tables are paid in full when you buy them. A wall poster is paid when it is approved, as described in section 8.

6. How the contract is made

The items in the game's catalog are not binding offers; they show what you can buy. Buying one goes like this:

  1. You choose an item and press Buy. You are taken to Stripe's payment page, which shows the item and the price.
  2. You can check everything there, and go back to the game without paying at any point before you pay.
  3. You tick the box to agree to these terms and to ask for the item to be unlocked straight away (see section 9), and you pay.

Paying is your binding order. The contract is made when your payment is confirmed and the item is unlocked on your account.

We then send a confirmation to the email address of your account. It names the item, the price and the date, names us as the seller, links to these terms, and confirms that you asked for the item straight away and acknowledged that this ends your right of withdrawal. Keep it: it is your copy of the contract.

These terms are always available at traluno.com/terms, and you can save or print this page. We keep a record of each purchase and every earlier version of these terms; if you ask, we send you the version that applied to your purchase.

7. Delivery

Premium items and tables are delivered at once: they are unlocked on your account as soon as the payment is confirmed, usually within seconds, and you can place them in any of your layouts. If something you paid for has not appeared after a few minutes, write to us.

Traluno runs in a current web browser with WebGL. An item needs nothing else.

8. Wall posters

Submitting. You upload an image, choose a wall and, if you like, give a web address the poster links to. You then enter a card on Stripe's page. The card is saved, not charged. You allow us to store the image and to show it, with its link, in Traluno for the display period.

Review. A person checks every poster before it goes up. We may decline a poster without giving reasons, and a declined poster is never charged.

The contract. Submitting a poster is your offer. The contract is made when we approve it: the saved card is charged the price shown for that wall when you submitted the poster, and the poster goes up straight away. If the charge fails, the poster does not go up and nothing is charged.

Cancelling before approval costs nothing. Write to us at any time before the poster is approved and we remove it. Nothing is charged.

Display. An approved poster hangs on the wall you chose, in every room of the game, for 30 days from approval. Every player sees it, but we do not promise a number of views.

What a poster may show. Only what you are free to publish. Nothing you do not have the rights to, nothing unlawful, nothing sexual, violent, hateful or discriminatory, nothing misleading, and no link to anything of that kind or to harmful software. A link must be an ordinary http or https address.

Removal. We take a poster down if we learn that it, or the page it links to, is unlawful or breaks these rules, including when someone reports it to us. We tell you why, and if you reply we look at it again. If a poster comes down early because it broke these rules, the remaining days are not refunded. If it comes down early for any other reason, we refund the days it did not get.

9. Your right of withdrawal

This section applies to consumers.

Premium items and tables

As a consumer you normally have fourteen days to withdraw from a contract made online, without giving a reason. For digital content such as a premium item or a table, that right ends when delivery begins, provided that:

  1. you expressly agreed that delivery would begin before the fourteen days were over,
  2. you acknowledged that by agreeing to this you lose your right of withdrawal, and
  3. we confirmed the contract, including that agreement and acknowledgement, on a durable medium such as an email.

The box you tick on the payment page covers the first two, and the confirmation email is the third. Because the item is unlocked as soon as you have paid, your right of withdrawal ends at that point. If we have not sent you that confirmation, it has not ended, and you can use it as described below.

This follows Art. 16(m) of Directive 2011/83/EU and § 18 (1) Z 11 FAGG.

Wall posters

A poster is a service, and the right of withdrawal applies to it in full.

Before approval you can cancel at any time, free of charge (see section 8). After approval you can withdraw within fourteen days of the day the poster was approved. Because you asked for it to go up as soon as it was approved, you then pay for the days it was already on display, in proportion to the full 30 days, and we refund the rest.

Withdrawal information

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Timesheet - Mobile Time Tracking OG, Untere Weißgerberstrasse 43 1/2, 1030 Vienna, Austria, hello@traluno.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

If you withdraw from the purchase of a premium item or a table, it is removed from your account.

10. Warranty

If you are a consumer, the statutory warranty for digital content and digital services under the Austrian Consumer Warranty Act (Verbrauchergewährleistungsgesetz, VGG) applies, and nothing in these terms limits it. What you buy must be as described and must work in Traluno. If it does not, you are entitled first to have it put right. If that is not possible, or we do not do it within a reasonable time, you can have the price reduced or end the contract and get your money back. We also provide the updates an item needs to keep working.

You can claim for a defect that shows within two years of delivery, or, for a poster, while it is on display, and you can still take a claim to court for three months after that.

If you buy as a business, the statutory warranty under Austrian law applies.

To report a fault, write to hello@traluno.com.

11. Liability

We are liable without limit for damage we cause intentionally or through gross negligence, and for personal injury. For any other damage caused by slight negligence, we are not liable.

This does not affect your warranty rights (section 10), or any liability that the law does not allow to be excluded, such as under the Product Liability Act.

12. Changes to Traluno and to these terms

Traluno keeps changing. We may change, improve or rework the game and the items in it at no cost to you: to fix faults, to keep it secure, to keep up with browsers and the law, or to make it look and play better. A change may alter how an item looks or behaves.

If a change makes something you have paid for significantly harder to use, we tell you by email in good time before it happens. You can then end the contract for that item free of charge within 30 days of the change or of our email, whichever is later, and we refund a proportionate share of the price.

If we ever close Traluno, we tell everyone who has bought something by email at least three months before. Your statutory rights are not affected.

We may update these terms. A new version applies only to purchases made after it is published. What you bought before stays under the terms that applied when you bought it.

13. Law and courts

These terms and every purchase are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer and live in another country, you keep the protection of the mandatory rules of that country's law (Art. 6 (2) Rome I Regulation): choosing Austrian law takes none of it away.

If you are a consumer, you can bring proceedings against us in Austria or in the courts of the place where you live, and we can bring proceedings against you only in the courts of the place where you live. If you buy as a business, the court with subject-matter jurisdiction in Vienna, Austria, has exclusive jurisdiction.

14. Contact

Questions, complaints, withdrawals and anything else about a purchase go to hello@traluno.com, or by post to the address in section 1.
